First of all, you should know Jamin Coller is responsible for all the content on LearnPianoLive.com – both the impressive and the highly objectionable. Secondly, we’re likely change these terms of service without bothering you to tell you about it, so you should check back and read this again regularly to be sure you still agree. Please be aware that using this site means you whole-heartedly agree with the entire terms of service. If you don’t agree, you should discontinue use of the site immediately.
1. RESTRICTIONS ON USE
Since Jamin feeds his wife and small children with the money he makes from this website, you may not steal from his family by reproducing, duplicating, distributing or selling anything you get from LearnPianoLive. If we find that you’ve tried any of that, we’ll cut off your access to our services and products without notice and without refund.
INFORMATION SHARING WITH NONAFFILIATED THIRD PARTIES
We’re not interested in sharing any of your private information. We don’t really like having the responsibility of possessing your information, but some of it is necessary to provide a great piano learning experience. But we don’t sell, rent, or lease about your information. If you have been contacted by a party other than LearnPianoLive, and you think it’s because we gave your information out, let us know at the contact page. That’s not cool.
HOWEVER, we're also not interested in hiding your information for you. It's your job to keep your secrets your secrets. If you want it hidden, don't share it with us. If we like you, we might respond to you by name during a live lesson, feature a video of you, or even let you participate in the studio. As any reasonable person should assume, those interactions will NOT be private. We will try to remember not to blurt out your email address or social security number or mother's maiden name to all the other students, but accidents happen and we can't promise those things won't accidentally slip out. If it does, you can get back at us by stopping your membership, but you can't sue us. Should have thought of that before you went and signed this agreement.
2. LICENSE
Everything from LearnPianoLive.com contains proprietary information that is protected by intellectual property, copyright, trademarks, patents or other proprietary rights and laws. You may not modify, rent, lease, loan, sell, distribute or create derivative works based on the Web site, the Course Content, or the Software, in whole or in part. That also applies to website itself, so you may not (and may not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the website. You may not try to gain access to restricted parts of the website you haven’t paid for. Instead, put that energy into working at a real job and you’ll be able to pay for the lessons legitimately. That way, we both get paid.
3. INDEMNITY
You agree to indemnify and hold LearnPianoLive, and its employees, agents, affiliates, and co-branders, or other partners, and other users, harmless from any claim or demand, including attorneys' fees, made by any third party due to or arising out of Content you may submit, post, transmit or make available through the Web site, your use of the Web site, your connection to the Web site, your violation of the TOU, or your violation of any rights of any third party.
4. DEALINGS WITH THIRD PARTIES
You can’t hold us responsible for some problem that arises from your dealing with other people, even if you met them on our site. Your correspondence or business dealings with, or participation in promotions of, third parties (companies, jobs, gigs, music teachers and other users) found on or through the Web site, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that LearnPianoLive shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Web site.

The Web site may provide, or third parties may provide, links to other internet sites that we have no control over, so LearnPianoLive is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You have to deal with those people at your own risk.
6. DISCLAIMER OF WARRANTIES
If you have any problems with our services or products, let us know and we’ll fix what we think is reasonable, but we’re providing this service “as is” and “as available”. We provide no warranties and no guarantees. In fact, even if someone on the website tells you directly that there IS a warranty or guarantee, we’re telling you right now: there isn’t. That person is mistaken.
Our site does necessarily make you thinner, happier, more attractive, more employable, or live longer, but we also have not been able to prove that it doesn’t. You’ll have to find out for yourself. If our site goes down, if our teachers make you feel belittled or angry, if you download something from our website that gives your computer a virus, we don’t guarantee we’ll give you anything that will make up for it or make you happy again. But all that said, we really think you’ll like it.
7. LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT LearnPianoLive SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF LearnPianoLive HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), WHETHER BASED ON CONTRACT, TORT OR STRICT LIABILITY, OR OTHERWISE, RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE WEB SITE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND ONLINE SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR ONLINE SERVICES PURCHASED OR OBTAINEDOR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE WEB SITE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE WEB SITE; OR (v) ANY OTHER MATTER RELATING TO THE WEB SITE. 8. TERMINATION
We reserve the option of terminating your account for any reason at all. We’re trying to keep a very inclusive, un-offensive, happy atmosphere around here, so if you’re even close to violating this terms of use, if you’re mean in the chat rooms, if you’re stealing our stuff, if we just don’t like something you’re saying, doing, or thinking, we can terminate your account without giving your money back. We don’t do it very often, so most people having nothing to worry about, but if you’re thinking about doing something on the site that you’re afraid won’t be socially acceptable, we recommend you don’t.
9. GENERAL INFORMATION
This document supersedes any agreements you may have had with LearnPianoLive. And don’t forget: you also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. The terms of use and the relationship between you and LearnPianoLive shall be governed by the laws of the State of California, USA without regard to its conflict of law provisions. You and LearnPianoLive agree to submit to the personal and exclusive jurisdiction of the courts located within the County of Sacramento, CA, USA. The failure of LearnPianoLive to exercise or enforce any right or provision of the terms of use shall not constitute a waiver of such right or provision. If any provision of the terms of use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the terms of use remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Online Service or the terms of use must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the terms of use are for convenience only and have no legal or contractual effect.
